Privacy Policy
Book Depot Inc. (“Book Depot” or “us” or “we” or “our”) owns and operates sparkbookfairs.com and sparkbookfairs.ca, (each a “Site”). This Privacy Policy (“Policy”) contains details about how Book Depot collects, uses, shares and stores your information when you use the Site, do business with us over the telephone, send us emails or faxes, interact with us through social media, or when you provide information to us through any other interactions you may have with Book Depot (collectively and together with the Site, the “Services”). This Policy also explains how you can exercise certain rights you may have in connection with your privacy and personal information.
This Policy covers only the Services identified above. Other websites, mobile applications, and other services, whether online or offline, may have their own privacy policies, and you should consult those accordingly. For example, the Site may contain links to external websites or other online services, including those embedded in third-party advertisements or sponsor information, which are not controlled by Book Depot. Book Depot is not responsible for the privacy practices and data collection policies for such third-party services. You should consult the privacy policies of those third-party services for details. Book Depot may also allow interaction between the Site and other online services such as social media providers. This may include plugins available through the Site that allow you to share information with persons outside of the Services. Please consult the privacy policies of such third-party providers before using them to make sure you are comfortable with the level of sharing and their privacy practices.
The Services are intended for users 18 years of age or older.
This Policy is effective as of: January 1, 2021.
Policy Changes
Book Depot reserves the right to make changes to this Policy at any time. Since this Policy may change over time as we modify or expand our Services or as applicable laws change, we suggest that you check back from time to time in order to understand how we treat your information. Our Policy’s effective date will always be set forth at the beginning and end of the Policy. Any changes will be immediately incorporated into this Policy, and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.
Any change to this Policy is effective immediately. Your continued use of the Services after any changes are made to this Policy constitutes your acceptance of the changes. If any changes are unacceptable to you, you should cease all use of the Services.
If any changes to this Policy materially affect how Book Depot treats or handles personal information that you have already provided to us or that has otherwise been collected by Book Depot, we will notify you by email (if Book Depot has a valid email address to use) and give you thirty (30) days to opt-in to the changes as they pertain to your information If you do not opt-in, your information will continue to be used in a manner that is consistent with the version of this Policy under which it was collected, or the information will be deleted.
Information Book Depot May Collect
Personal information (“Personal Information”) is generally defined as information that alone or in combination with other information, could identify, relate to, describe, reference, be reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. The information we collect includes certain kinds of Personal Information. Categories of Personal Information can include but are not limited to, your name, shipping/billing address(es), telephone number, email address, username and password, IP address or other online identifiers, browsing or search history, credit/debit card number or other financial information, professional or employment-related information, office address and other business information, demographic information, consumer preferences, biometric information such as fingerprints, precise location information, or any other type of information that, directly or indirectly, is reasonably capable of being associated with you.
There are areas of the Services where you may be asked to provide Book Depot with Personal Information or other data, or where such Personal Information or other data may be collected from you in an automated manner. For example, Personal Information (and other related data) such as your name, shipping and billing address(es), email address, phone number, password or other account access information, credit/debit card or other payment information, and/or internet protocol (IP) address and other persistent online identifiers may be collected from you when you:
- contact Book Depot with questions, comments or other messages
- order Book Depot products;
- purchase a Book Depot gift card;
- sign up to receive Book Depot special offers, giveaways and other communications about Book Depot products and services;
- participate in Book Depot contests, sweepstakes or other promotions;
- complete and submit your answers to Book Depot surveys and questionnaires; and/or
- otherwise provide any information to us voluntarily through the Services.
Depending on the nature of the activity, such as if you publicly upload or post content with Personal Information through the social media aspect of the Services, other users of the respective social media service and our Services may be able to view your Personal Information.
Book Depot may use your Personal Information and other data to
- process orders and payments for gift cards, products or services offered on or through the Services;
- maintain proper business records and other relevant records;
- respond to your questions, comments or other messages;
- send you communications about Book Depot products or services;
- contact you regarding your orders and shipments, or if there are issues with any content you may have uploaded or posted through the Services;
- administer Book Depot special offers, giveaways, contests, sweepstakes or other promotions;
- process your responses to Book Depot surveys and questionnaires;
- provide ongoing technical support related to the Services;
- communicate with you regarding additional uses of your Personal Information beyond the scope of this list or the Policy;

Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what website or search terms referred you to the Site, and information about how you interact with the Site. How Book Depot Gathers Information
We may collect Personal Information when you register an account for the Services, visit certain areas of the Site, purchase products through the Services, submit questions or comments, subscribe to any communications from us, or otherwise voluntarily provide it to us.
We may collect information, including Personal Information, from third-party services such as Facebook or Google+ if you choose to create, log in, or connect to your Book Depot account using an account you maintain with the respective third-party service(s). For example, when you log in with your Facebook credentials, we may collect Personal Information from your Facebook profile, such as your email address, profile picture, and friend list. Please consult the privacy policies of each social media channel for more information about their privacy practices.
We may collect Personal Information through your communications with our customer service representatives. Book Depot may collect other Personal Information such as credit/debit card numbers or other order information whenever you authorize a transaction through the Services.
Other data, such as device information that may be Personal Information to the extent such data are reasonably capable of identifying you, could be collected in an automated manner whenever you visit or use the Services. For example, when you access or use the Services, we and third parties that may provide certain functionality on the Services, such as social media or advertising networks, may engage, receive, collect, and store certain online identifiers through automatic data collection tools including cookies, pixel tags, web beacons, embedded web links, and similar technology. These technologies may collect information including, but not limited to, your IP address, browser type, the date and time that you use the Services, referring/exit pages and URLs, number of clicks, cookies that may uniquely identify your browser, and information about your mobile device.
Cookies are small text files placed in visitors’ web browsers to store their preferences or provide certain functionality. Book Depot uses cookies to determine if you are logged on to our Site, keep track of your user preferences, and analyze user traffic on our Site to improve your user experience. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly.
By using the Services, you are authorizing us to gather and retain data, including Personal Information, related to Book Depot’s provision of the Services.
What Does Book Depot Uses Your Information For
Depending on the nature of your interaction with us, Book Depot may use your Personal Information and other data to:
- administer and secure your account;
- maintain proper business records and other relevant records;
- respond to your questions, comments or other messages;
- send you Book Depot newsletters and other updates with information or advertising relating to our products or other Services;
- process payment method and other order information when you order a product or anything else through the Services;
- contact you if there are issues with information or content that you uploaded or posted through the Services;
- provide ongoing technical support related to the Services;
- communicate with you regarding additional uses of your Personal Information beyond the scope of this list and Policy;
- deliver products ordered through the Services;

Book Depot uses the contact information and order information you provide to fulfill any orders placed through the Services (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).
We use the device information and other data we collect to help Book Depot screen for potential risk and fraud (in particular, your IP address and billing address), and more generally to improve and optimize our Services (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
The Site uses Google Analytics, which are web analytics services provided by Google Inc. ("Google"). These services from Google use cookies to analyze your use of the Site. The information collected by these cookies about your use of the Site (including your IP address) is transmitted to and stored on a Google server in the United States. Google uses this information to assess your use of the Site, providing reports on data such as how often you visit the Site, what pages you view when you visit the Site, and what other website you have visited prior to visiting our Site. Google may transfer this information to third parties, if required by law or if third parties process the information on behalf of Google.

Processing By Service Providers
Except as noted herein, Book Depot does not share or sell your Personal Information with any person or entity outside of Book Depot.
Book Depot may use certain Personal Information we collect from you to provide you with targeted advertisements or marketing communications that may be of interest to you. More specifically, the online identifiers and certain device information we collect from you, which could include Personal Information to the extent they are reasonably capable of identifying you, may be collected and managed by our outside marketing vendors in order to provide you with targeted ads based on what you appear to be interested in as a result of your activity online, both on our Site and elsewhere. Depending on where you reside, this sharing of potential Personal Information for targeted advertising purposes may be considered a “sale,” in which case you may have the right to opt-out of this processing activity.

We are not responsible for third parties or third-party services associated with advertising and analytics services and related tracking activities. Consult their privacy policies and notices for information on their practices. You can opt-out of receiving targeted ads served by us or on our behalf by clicking here. If you opt-out, you will still see ads but they will not be personalized based on your online activity. Please note that if you disable your cookies or upgrade your browser after opting out, you will need to opt-out again. Further, if you use multiple browsers or devices you will need to execute this opt-out on each browser or device.
You can also generally opt-out of receiving targeted ads from third-party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) here. You may opt-out of receiving targeted ads from other companies that perform interest-based advertising services, including some that we may work with, via the Digital Advertising Alliance (DAA) site at Your Ad Choices or by setting your web choices here. There is no guarantee that all targeted and interest-based advertising will be removed by using the above-referenced industry opt-out tools. We are not responsible for the effectiveness of, or compliance with, any third parties’ opt-out options or programs or the accuracy of their statements regarding their programs.
We may disclose certain portions of your Personal Information to service providers or third-parties as necessary to fulfill the business purposes for which the Personal Information was collected. Whenever we hire other organizations to provide support services, they will be required to conform to our privacy standards. These third parties shall use the Personal Information only for purposes related to the supply of services to us and they will also respect strict contractual conditions that oblige them to maintain the confidentiality of all information.
We may share any information, including Personal Information, that we receive with vendors and service providers retained as necessary for business purposes in connection with the provision of the Services. For example, we may provide contact information such as your name, address, email address or phone number to shipping/mail and email service providers to send you products, newsletters, and other materials you order or request.
We may use a third-party service provider to process payments, and in such cases, we will share applicable Personal Information, including order information such as your payment method and related financial data, with that payment processor as necessary to fulfill your order.
The Services may allow you to share information, including Personal Information, with third-party services and social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct the Services to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their website. Please consult the privacy policies of these third-party services and websites before using them to make sure you are comfortable with the level of sharing.
We may also disclose your Personal Information to other service providers and for other purposes with your permission, or for one or more of the following purposes:
- To carry out our obligations and enforce our rights arising from any contracts related to your use of the Services, including for billing and collections;
- As necessary or appropriate to protect the rights, property or safety of Book Depot, our customers or others;
- To respond to law enforcement requests and as required by applicable law, subpoena, court order, other legal process or governmental regulations;
- As otherwise described to you at or before the point when we collect your Personal Information; or
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or to transfer some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
Book Depot will not disclose your Personal Information to law enforcement entities, government entities, or other persons unless permitted or required to do so by the following: (i) any lawful method or process by which a law enforcement entity is permitted to obtain such information; (ii) a court order with sufficient notice to both Book Depot and the user so that either can contest disclosure; (iii) the user has given informed, affirmative consent in writing to the specific disclosure to the specific person for a particular purpose; (iv) Book Depot’s reasonable good faith belief that the Personal Information collected through the Services is evidence related to a crime against Book Depot or the user; and/or (v) an imminent danger of death or serious physical injury requiring disclosure of Personal Information, but only when the law enforcement entity requesting disclosure has applied for and received approval for a valid search warrant. Upon the written request of a law enforcement entity to preserve a user’s Personal Information, pending receipt of a request or demand for such Personal Information pursuant to the conditions listed above, Book Depot will retain the relevant records and evidence for 90 days from the date of the preservation request by the law enforcement entity, renewable for another 90-day period following a renewed written request by the law enforcement entity.
We may also disclose your Personal Information with other kinds of vendors and service providers if we have obtained your permission or consent to do so.
By providing to Book Depot the Personal Information and other data referenced above, you agree that Book Depot may use such Personal Information and other data in accordance with the terms of this Policy. We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
Book Depot neither collects nor sells the Personal Information of minors under 18 years of age.
Your Rights and Choices
Depending on where you reside, you may have one or more of the following rights with regard to Book Depot’s collection, use and sharing of your Personal Information on or through the Services: The right to request details about what Personal Information we collect, use, disclose or sell about you;
- The right to request the deletion or correction of Personal Information we have collected or maintain about you;
- The right to opt-out of any sale of your Personal Information; and
- The right not to receive discriminatory treatment by Book Depot, in terms of the services, products and prices offered on or through our Services, because you exercised these rights regarding the collection, use and sharing of your Personal Information.

You or a person authorized on your behalf has the right to request to see and obtain a copy of your Personal Information and to request changes or corrections to inaccurate or incomplete information. Please note that we may charge a minimal fee for processing such requests.
You may be able to opt-out of Book Depot sharing your Personal Information with the entities identified in this Policy/Notice by contacting us using the information above, unless the sharing of your Personal Information is necessary to perform one of the following business purposes: to count ad impressions and evaluate their effectiveness; to detect, protect against, and prosecute security incidents; to debug or troubleshoot functional errors that may arise with the Services; to complete short-term tasks related to an existing interaction you have with Book Depot; to maintain or service your account; to process payments and fulfill orders or other transactions you authorize; to verify your customer information; and to ensure the safety and quality of the Services.
Any removal of content by Book Depot does not ensure or guarantee complete or comprehensive removal in all places. The content may have been shared or reposted by other parties, or federal, provincial or state law may require maintenance of the content or information. Book Depot will do its best to accommodate your request, but we cannot guarantee we can remove all Personal Information from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that Book Depot needs to make certain Services function properly for you, you may not be able to use those Services properly moving forward. We may deny your deletion request if retaining the information is necessary for us or our service providers to:
- Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise to perform a contract we entered into with you;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
- Debug products to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546) (as applicable);
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
- Comply with a legal obligation; or
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Book Depot reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your Personal Information.
You may grant an authorized agent written permission to submit requests regarding your Personal Information, but we may deny authorized agent requests absent proof that you authorized such agent to act on your behalf, or if we are unable to verify your identity.
Book Depot is required to verify the identity of any person or entity that requests the disclosure or deletion of Personal Information. If you have a password-protected account with us, we will use our existing authentication procedures to verify your identity. For most other requests, Book Depot will ask you to provide information that matches at least two pieces of Personal Information we store about you before responding to your request. If you would like to request the specific pieces of your Personal Information that Book Depot has collected, or if you would like us to delete highly sensitive information, you will need to match at least three pieces of information we store about you, and you must provide a signed declaration under penalty of perjury that you are the consumer whose Personal Information you are requesting.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Book Depot does not knowingly collect any information from persons under 13 years of age, nor are the Services directed at or intended for persons under 13 years of age. If a person under 13 years of age uploads/posts information through the Services without authorization, and such information becomes publicly available, please contact us immediately at [email protected]. If Book Depot learns we have collected or received Personal Information from any person under 18 years of age, Book Depot will delete such information immediately. Again, any removal of content by Book Depot does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information.
California Residents Only:
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of Personal Information the business shares with third parties for those third parties' direct marketing purposes and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. To exercise your rights, you may make one request each year by emailing us at [email protected].
Some browsers also have a ”do not track” feature that lets you tell a website that you do not want to have your online activities tracked, and Book Depot will attempt to treat such technical signals as valid opt-out requests for online tracking related to targeted advertising. Options you select are browser- and device-specific, and there is no guarantee that these industry-provided opt-out tools will prevent all targeted advertising.
Email Communications
By providing us with your email address, you agree to receive communication primarily through email. This means that you are opting in to receive email communications from Book Depot and its brands, in accordance with the guidelines and limitations outlined below. You will always have the option to “opt out” or “unsubscribe” from these emails after initially opting in. Please refer to the unsubscribe link at the bottom of every email.

Email Communications Subject to Implied Consent
In some instances, your consent to receive email communications from us will be implied. For example, when you provide your email address to us at the time of making a purchase on the website, your consent to receive emails related to the transaction—e.g., a purchase or shipping confirmation email—is implied. When your consent is implied, we will only send you email communications that directly apply to the business purpose of your original request, and your implied consent will automatically expire once the business purpose of your transaction has completed. All email addresses that fall under implied consent guidelines will expire from our email database 24 months to your last interaction with the brand, unless you choose to withdraw or change your consent prior to that date.
Email Communications Subject to Express Consent
If you would like to receive email communications regarding products, promotions, contests, and surveys that may be of interest to you, it is necessary for you to provide express consent. You can provide this consent by signing up for an account on a Book Depot website or responding to a direct communication request for consent. Once you have given express consent, it will remain in effect and will not expire unless you explicitly request to "opt out" or "unsubscribe".
Unsubscribing from Email Communication
Within every email communication we send, we will always offer you the chance to "opt out" or "unsubscribe". If you wish to unsubscribe from our email communications, simply click on the unsubscribe link located at the bottom of any of our emails.
Forwarding/Sharing of Email Communication
If you forward or share any email communications you have received from us, you assume responsibility for the email communication. As a result, Book Depot will not be held liable for any responsibilities or liabilities that may arise from the transmission of that email communication to another party.

Securing Personal Information
While Book Depot takes the issue of protecting your Personal Information seriously, you should exercise discretion in what information you disclose and/or transmit through the Site. Book Depot cannot guarantee that information sent over the internet is fully secure. The transmitted information may be intercepted by others before it reaches Book Depot. If you are concerned about sending information to Book Depot over the internet, please send the information by mail or call us to make other arrangements. Book Depot is not responsible for the security of information sent over the internet.
We take all reasonable steps to protect the security and confidentiality of your personal information. We protect the personal information within our custody or control with appropriate organizational, technological and physical safeguards.
We store personal information in electronic and physical files that are secure, and our security measures include secure on- and off-site storage, restricted access to records and data processing equipment, password protocols, and encryption and security software. We conduct audits and monitor compliance with our privacy practices.
Book Depot retains collected information for a reasonable amount of time in order to fulfill the stated purpose for why the information was collected. Book Depot will also retain collected information connected to business records for periods of time required by law. If Book Depot determines that collected information is no longer needed, it will delete such information. Our collection times will be consistent with applicable law.
Children's Privacy
The Services are intended for individuals 18 years of age and older located in the United States and Canada.
The Services are not directed at, marketed to, nor intended for, individuals under 18 years of age. No one under the age of 13 is permitted to provide any information on or through the Services. If you are under 13 years of age, DO NOT use or provide any information on or through the Services; use any of the Services’ features; use any interactive or public commenting feature on the Services; and/or provide any information about yourself to Book Depot. Book Depot does not and will not knowingly collect any information, including Personal Information, from any person under 13 years of age and Book Depot will take prompt steps to delete any such information if it is inadvertently received. If Book Depot learns that we have received Personal Information from any person under 13 years of age, Book Depot will delete that information. Non-U.S. Concerns
If you provide information to Book Depot from outside of the United States, you do so at your own risk. If you are outside of the United States, you are responsible for complying with any local laws regarding your use of the Services, and any related data collection. You also agree and acknowledge that by providing any information, including Personal Information, through the Services, that such information will be transmitted to, and stored in, the United States.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information, you consent to any transfer and processing in accordance with this Policy.
Legal Residents of Canada: Your personal information may be stored, processed or otherwise used by our affiliates, our service providers, both inside and outside of Canada or us. As a result, the applicable country's courts, governments or law enforcement agencies could obtain disclosure of your information in accordance with that country's laws.
Depending on the nature of the personal information, it may be stored in our or in various computer systems we use or that are used by our service suppliers, or in storage installations we use or that are used by our service suppliers.
How We Handle EU Data
If you reside within the European Economic Area (the “EEA,” which includes the 27 European Union Member States, Iceland, Norway and Liechtenstein), Switzerland or the United Kingdom (collectively, the “EU”), then Book Depot handles your Personal Information and data according to the terms of this Policy, unless the exceptions in this section apply, pursuant to the General Data Protection Regulation (“GDPR”).
